The Main Prosecution Witness, P Dale.

On Friday morning 4th February 2005, P Dale was leaving for work at 4.50 am. She alleges she heard a motor vehicle driving into Oaks close, Fornham St Martin, Bury St Edmunds. Dale lived across the road from Dawn Walker.

In her statement she said “I found this a bit of a comfort”, she locked the back door and walked a few steps to her car, as she did so she noted the vehicle had not reached the end of the close. She got into her car then backed out of her drive. She then scraped ice off her windscreen. From the Meteorological Report for Friday 4th February 2005 for the area, there was no ground frost any time that morning. So this meant she would have had to get out of her car - but she had already moved her car off the drive?

From those few seconds of manoeuvring her car; this witness says she saw 2 people, by a silver car, a Volvo estate, which had parked on Dawn Walker's drive, facing the house.

In that short time, the witness states she saw the two men carrying a large heavy object, could have been a rolled up carpet/underlay, laundry bag or similar to a sack of potatoes but no longer, across the lawn of Dawn Walker's home, and one of the men continued to load this heavy object into the side back door of the Volvo estate whilst she drove by. This man supposedly carried on bundling this item into the side door, despite being seen by this witness.

In court, on oath, she said she thought the 2nd person was Dawn Walker and assumed it must be Kevin Nunn as the person struggling with the heavy object. He supposedly stared back at her with a "glazed expression".

Dale carried on and drove to her workplace and made no mention to anyone at the time. She also said she saw Kevin Nunn clearly as Dawn Walker's house "seemed really bright, it appeared well lit up at the side of the house" and " he stood almost directly under the street light".

The street light is some 20 feet away from Dawn Walker's drive! In her statement she also said "I wasn't really studying what these two were actually doing".

On door to door enquiries by the police on the Saturday 5th February 2005 (the very next morning) this witness did not say anything about the argument, despite adding on another statement, hearing a women shouting for help. P Dale did not say anything about seeing a silver Volvo with 2 people and a heavy object or allegedly seeing Kevin Nunn in the early hours of Friday morning.

It took her another 10 days for her to make a number of statements to Suffolk Police.

By the time Dale made the ID photofit, Kevin Nunn's photograph had been on the local news, and in local papers – speculation had already started. Kevin Nunn did not give any interviews or make any comments prior to his arrest. He co-operated fully with all of the police enquiries, did not get a solicitor until he was arrested on March 14th 2005 and subsequently charged with Dawn's murder on March 16th 2005.

This same witness Dale, states that her neighbour (the who had a previous violent relationship with Dawn) told her some weeks before Dawn Walkers's death, that he knew how to "commit the perfect murder". He gave details which were quite specific and required insightful knowledge of such events.

This man was not brought in for questioning and refused to give full co-operation to Suffolk Police. His statements, were many and were scattered with inconsistencies - this continued when he was called as a prosecution witness during the trial. Judge Cox in her summing up referred to this man as being a fantasist!
